1.About Our Services
NextArt Digital provides digital marketing, creative, technology and business growth services, including AI Automation, WhatsApp and Instagram automation, AI chatbot solutions, Product Demonstration and Product Content, E-commerce Product Listing Support, Social Media Marketing and Account Management, SEO and Search Engine Optimization, Website Development, Landing Pages, E-commerce Website Development, Branding and Creative Design, Graphic Design, Content Creation, Digital Strategy and related services. Specific services, deliverables, pricing, timelines and requirements will be confirmed in the applicable quotation, proposal, invoice, service agreement or statement of work.
2.Quotations & Proposals
Quotations issued by NextArt Digital are generally valid for 15 days unless another validity period is stated in writing. A quotation is not considered a final contract until it has been accepted by the client and the required advance payment or other agreed confirmation has been received. Prices displayed on the website are starting prices unless explicitly stated otherwise. Final pricing may vary depending on project complexity, quantity, revisions, integrations, custom development, urgency and third-party costs.
3.Payment Terms
Unless otherwise stated in the applicable quotation or service agreement, 50% advance payment is required before project work begins and the remaining 50% is payable upon completion or delivery. Monthly services are payable at the beginning of each billing cycle. Services may be paused where required payments remain outstanding.
4.Monthly Services
Monthly services may include SEO, Social Media Management, AI Automation Management, marketing support, content services, reporting or other recurring services. Monthly services continue according to the agreed billing period until cancelled or terminated according to the applicable service agreement. Non-payment may result in suspension of services.
5.Project Scope
Only services and deliverables specifically included in the approved quotation or agreement are included in the project price. Requests outside the original scope may require additional fees, additional time, a revised quotation or written approval before work begins.
6.Client Responsibilities
The client agrees to provide accurate and complete information reasonably required to perform the services. This may include business information, logo and brand assets, product photographs and videos, website content, social media access, product information, login credentials where necessary, approvals and feedback. The client is responsible for ensuring that materials supplied to NextArt Digital do not infringe the rights of any third party.
7.Revisions
Up to 2 revisions are included for standard creative work unless otherwise stated in the quotation. A revision means a reasonable modification to an existing approved direction. A complete change of concept, redesign, new requirement or additional deliverable may be treated as additional work.
8.Website Development
Website development services may include design, development, responsive implementation, forms, WhatsApp integration, basic SEO setup, speed optimization and other deliverables specifically identified in the quotation. Domain registration and renewal, hosting, premium themes, premium plugins, third-party APIs, payment gateway fees, email services, SMS services, AI services, software subscriptions, stock assets and other third-party services may be charged separately unless specifically included.
9.Domain & Hosting
Domain names and hosting services may be purchased, managed or renewed on behalf of clients when agreed. The client is responsible for applicable recurring domain, hosting, email, software, API and third-party service charges unless otherwise stated. Failure to renew required services may result in service interruption or loss of access.
10.SEO Disclaimer
SEO is an ongoing process influenced by search engine algorithms, competition and many external factors. NextArt Digital does not guarantee specific Google rankings, traffic levels, lead volumes, sales or a specific time period for ranking improvements.
12.Advertising
Advertising budgets are not included unless specifically stated in writing. Advertising platform charges are separate from NextArt Digital service fees. NextArt Digital is not responsible for platform outages, account restrictions, ad disapprovals caused by platform policies, suspensions, changes in advertising costs or other platform-related issues outside our reasonable control.
13.AI Automation & Third-Party APIs
AI automation, chatbots, WhatsApp automation, Instagram automation, customer messaging and related services may depend on external platforms, APIs, software providers or AI services. These services may impose usage limits, additional charges, verification requirements, API restrictions or policy changes. Third-party subscriptions and API fees are separate unless specifically included in the quotation.
14.E-commerce & Product Services
For Amazon, Flipkart, Meesho or other marketplaces, NextArt Digital may provide product listing, optimization, creative design, product videos, AI videos and related services. The client remains responsible for product authenticity, legality, certifications, inventory, shipping, returns, taxes, marketplace fees and marketplace account compliance. Marketplace approval, rankings, sales volume and revenue are not guaranteed.
15.Intellectual Property
Unless otherwise agreed in writing, the client receives rights to final approved deliverables specifically created and paid for under the applicable project. NextArt Digital may retain ownership of pre-existing materials, templates, frameworks, reusable code, libraries, internal tools, workflows, processes and general know-how. Third-party assets remain subject to their applicable licenses.
16.Portfolio & Promotional Use
Unless otherwise requested in writing, NextArt Digital may display completed work in its portfolio, website, social media, presentations or case studies. Confidential project information will not intentionally be disclosed.
17.Confidentiality
Both parties agree to reasonably protect confidential business information received during a project and not disclose it to unauthorized third parties except where required by law or reasonably necessary to perform agreed services.
18.Third-Party Services
NextArt Digital may use third-party software, hosting providers, domain registrars, cloud services, AI platforms, social media platforms, analytics services, payment providers, APIs, email services and other technology providers. Third-party services are governed by their own terms and policies.
19.Client Approvals
The client is responsible for reviewing and approving content, designs, website pages, advertising materials, product information and other deliverables before publication or final release. Changes requested after approval may be treated as additional work.
20.Cancellation & Termination
Either party may request cancellation according to the applicable quotation or service agreement. For ongoing monthly services, the applicable notice period will be stated in the relevant agreement. Work already completed, committed costs and third-party services already purchased may affect refund eligibility.
21.Refunds
Because many services involve customized work, design, development, strategy, research, content production or time already committed, refunds are not automatically available once work has commenced. Refund eligibility will be determined according to the approved quotation, agreement, payment terms and applicable law.
22.Project Delays
Estimated delivery dates depend on timely client feedback, content, approvals, credentials and third-party availability. Delays caused by late feedback, missing materials, delayed approvals, third-party outages, API changes or platform restrictions may extend project timelines.
23.Website Availability & Maintenance
Website maintenance, updates, security monitoring, content changes, backups, hosting management and technical support are included only where specifically stated in the applicable package or agreement. Additional fees may apply otherwise.
24.Data & Privacy
When you submit information through this website, NextArt Digital may collect information such as your name, company name, email address, telephone number and project requirements. Our Privacy Policy explains how personal information is collected, used, stored and protected.
25.Website Use
You agree not to use this website for unlawful, fraudulent, abusive, malicious or unauthorized purposes and must not attempt to gain unauthorized access, interfere with the website, upload malicious software, copy protected content without permission or circumvent security measures.
26.Limitation of Liability
